Comcast’s class action lawsuit against its subscribers is interesting in many regards. The class action lawsuit describes a situation where a Comcast DSL service is found defective and causes a customer to incur additional expenses. The class action lawsuit further describes that Comcast has been aware that its DSL service is unreliable and potentially dangerous for many years. It seems to be an intentional act by Comcast to force these subscribers into a lawsuit so that they can force Comcast to fix its poor service conditions.

The class action lawsuit against Comcast was filed by a former subscriber of Comcast DSL. According to this class action lawsuit, subscribers are charged a monthly surcharge to cover costs related to repairing poor wiring within the home of the subscriber who didn’t, in actuality, pay for repairs for all poor wiring within the home. The surcharge also allegedly covers additional expenses such as postage and packing materials used to send the faulty cable back to Comcast. The entire situation is said to be designed to force subscribers to spend money on additional services such as Comcast Internet and electricity, rather than receiving an affordable plan that provides them with superior performance. It seems to be an attempt by Comcast to force customers to purchase expensive products that they don’t actually need in order to protect their own interests.

The class action lawsuit against Comcast was filed in the U.S. District Court for the Eastern District of Pennsylvania. On August 8, Comcast received a Notice of Default from the United States Federal Judge on this case. The Federal Judge found that Comcast did not provide consumers with a sufficiently affordable service. This resulted in a massive fine against Comcast that could cost them millions of dollars. One of the reasons why this class action lawsuit against Comcast was brought forth was because the Federal Judge found that Comcast repeatedly violated the FDCPA by repeatedly violating the terms and conditions of their DSL contracts.

The class actions lawsuit against Comcast was one of the first class actions cases to reach the United States Federal Court. Class actions are legal claims in which a group of people are able to receive compensation from a company via a lawsuit. Class actions are different from individual lawsuits, as they are filed by a group of individuals or groups instead of by an individual. Comcast received multiple class actions filed by consumers that were attempting to recover damages due to Comcast’s failure to properly service its subscribers.

The class action lawsuit against Comcast also includes a claim that the corporation failed to make reasonable offers to cover damages for the negligence of its employees. As we have seen above, Comcast’s business practices resulted in a significant number of consumer complaints and damages. In some instances, the corporation has been accused of withholding service calls that it should have made to its customers in an attempt to avoid paying for employee service claims. Further, the corporation has been accused of imposing unreasonable fees on its subscribers for its botched customer service system.

While class-action lawsuits are generally used in litigating employment or consumer protection claims, the class action lawsuit against Comcast is unusual in that it involves the relationship between the corporation and its subscribers. The court has discretion to award substantial damages to individual plaintiffs, but class-action lawsuits allow the court to use its discretionary power to award damages even to non-subscribers who were adversely affected by the defendant’s acts. In the case of Comcast, the court did not act to preclude class-action lawsuits, but instead chose to limit the damages that could be awarded by the jury to only those customers who had suffered direct damages from the negligent acts of Comcast employees.

  2. I was advised by a Comcast manager to make a police report against comcast concerning this matter. I made a payment on April 14, 2022, my bank confirmed Comcast received their funds on the 15 of April. The manage spoke with bank confirming and the bank also sent a letter of verification stating Comcast received the funds. I’ve spoken with numerous CSR, Supervisors, etc. I ask that the fraud department call me back to investigate this matter and that never happened. I was forced to terminate my service because they keep trying make me pay the same bill in the amount of 274.95. now the bill is now over 500.00 and threatening to turn this matter over to collection. I can’t have Comcast ruining my credit over a debt that I settled.
