Aspen Dental Class Action Lawsuit

Aspen Dental, also one of the country s leading corporate dental chains, is being hit by yet another class-action lawsuit charging it of illegally owning and running many crooked dental clinics all over the country and of falsely deceiving patients by aggressively selling expensive teeth whitening treatments to them after they have been lured in by false promises of free teeth exams and free dental X-rays. If this is not bad enough, the owner of this fraudulent dental practice has already been arrested on charges of health care fraud. This lawsuit is just another instance of the rampant greed and corruption that permeates American medical care today.

A Class Action Lawsuit is an instance in which several plaintiffs come together to file suit against the defendant in a court of law claiming damages for false promises made by the defendant in the course of carrying out his or her business. Such lawsuits are very common and almost every person who wants to pursue a case of dental injury or other types of medical malpractice can easily avail of such services. In the case of Aspen Dental this class action lawsuit filed by its former clients has alleged that the company systematically deceived both patients and their dentists into believing that they would be able to save the teeth of their patients by offering them unnecessary treatments at exorbitant costs, such treatments included the use of dangerous chemicals, the altering of clinical records to make it appear that the patients received a lower number of cavities and cleanings than they actually did, and the failure to provide the patients with adequate explanations as to why the treatments were necessary. Such actions were said to be done in violation of the statutes that promote patient protection. These statutes, among other things, require dental establishments to inform their patients of the risks of undergoing dental treatments and to ensure that such treatments are performed by qualified professionals.

The owner of this illegal clinic has been fined $75k for his wrongful acts towards its patients and the local Colorado district attorney is investigating the matter. If convicted, the dentist may also face jail time. For victims of this crime who are unable to afford to pay for damages due to their dentist’s negligence, a Denver dental clinic has agreed to accept a sum of money from them instead of covering their losses. Victims have to be willing to accept small monetary payments as a way of avoiding further financial damage.

The victims of this dental clinic crime can demand punitive damages not only because their teeth were damaged but also because they were subjected to unwarranted medical treatment. They can ask for a permanent injunction to be imposed on the dental clinic by the Colorado Supreme Court. If the dentists do not follow the stipulated court orders, the victims can seek compensation by filing a Colorado Class Action Lawsuit. Such victims can seek monetary compensation not only from the clinic owners but also from the patients who suffered injuries at the hands of the defendants.

This lawsuit can also claim payment for lost wages and past and future medical expenses that the patients have incurred due to the injuries sustained at the dental clinic. They can also seek compensation for past and present pain and suffering. The court can also order the dentists to post a mental health worker with proper medical training and certification to handle emergency situations. The victim patients can also demand compensation for the mental and physical stress that they have undergone due to the injuries sustained in the dental office. These damages can also include the cost of counseling.

A Denver dental clinic has to act reasonably when their employees treat patients with inadequate training or with inadequate equipment. Dental professionals must also take reasonable care when operating dental equipments. The dentists have to ensure proper maintenance and proper storage of the patient’s dental records. This Class Action Lawsuit can also claim damages for the mental and physical anguish caused to the patients.

  1. My 86 year old father in law went to Aspen dental in Summerville, SC starting in July of this year for dentures. It took over 3 months to get dentures that are questionable at best. The details of his visits go on and on, and I would like to find out how to participate in the class-action lawsuit.

  2. I’m a former office manager as of yesterday and I can tell you the patients are correct. The dentist come up with these thousands of dollars on treatment plans, making us get the patient to apply for credit. I got punished because I broke down the visits where it was more affordable and continue working on the treatment plan. There is so much I can say but I’m looking for a lawyer to sue Aspen.

  3. Is this class action law suit still active and going on ? I’m from Pittsburgh, PA and my experience with Aspen Dental was horrendous. On my 1st & 2nd visits I had to sign papers to have the work to begin. I was in so much pain I didn’t know I was signing up for Dental First, a credit card with Comenity Bank in Ohio. Every time I was rushed throughout my appointment. One of the dental techs even made the comment to me “I know it seems like we’re rushing you through, but really we’re not”. Why would she even say that to me if it wasn’t happening. Dr. Fazio broke every one of my teeth pulling them out, working the pliars back and forth one way and then the opposite way. He left my bottom jaw bone in large cracks and shreds. 4 months later I still can’t bite down without pain. Besides that, Dr Fazio yelled at me cause my whole body was shaking during the extraction. He had to give me more novacaine cause I felt every tooth he was working on. He kept yelling at me that the pain was all in my head. I will never go back to an Aspen Dental and I want them to pay for all my pain and anguish they have put me through.

  4. I am a patient of Aspen Dental in Greensboro, NC. On 11/18/2021 I went to have work done for a full set of dentures and now, 8/24/2022 I still do not have my new set of dentures. I have taken time off of work to go back to the practice several time for dentures that were horrible and cheaply made. No one in the office bothered to listen to my concerns or help. I now just want my money back or fix to this issue. I am very unhappy putting it mildly.

  5. This has been the worst experience of my life trying to get my dentures. This adventure started in July 2021. I have still not received my permanent dentures. Why you ask? Because Jan 2022 I got my permanent dentures. We tried them on and couldn’t even get them on. Then they realized that I had bones sticking out of my gums and that’s why the denture wouldn’t fit. So then the dentist grinded the bones down. After healing I went back and they realized that the dentist didn’t do all of it. So then they sent me to their Oral Surgeon Dennis Kantanen. He refused to do it and was a jerk and really rude to me. So then they told me to wait until they got a new dentist in and they said they would pay for it. Then I called to check on that and they didn’t want to do it because the other dentist already messed up my gums once. So then they decided to refer me to an Oral Surgeon outside the practice. Then I just found out today that they can’t pay for an outside Oral surgeon. So now they are waiting on the doctor to refund me on the last surgery so I can go elsewhere to get it done. Our insurance only covers Aspen Dental. I have been thru a lot with them and I have been calm about it but my husband is getting laid off and then I won’t have insurance so this process needs to hurry. Cynthia apparently doesn’t give a crap about anything. I have shed way too many tears over this entire process. I just want to get my dentures!!!!!

  6. Are there any Aspen lawsuits in Florida, or can I join this one. On my first visit after seeing the Dentist, I sat with the manager. All my teeth had to be removed. I had insurance and the total was a bit over $11,000 with a credit card company. Had the dentist told me that my procedure of placing posts on the bottom denture may fail, then I would have looked into a different dentist. Well, Yes, the posts failed. The pain was horrific. I also got a welcome gift that has denture cream with zinc.

  7. I paid $10,000.00 for false teeth that I cannot eat with! This is very embarrassing around family, out in public! For my teeth to come out when I am trying to eat!

  9. My dentures have worn down three different times. Now they’re blaming me saying I grind my teeth and I do not ground my teeth. I do not even sleep with my dentures on and now they’re saying will have to pay $6800 to have work done to my mouth. And they will not replace my dentures even though I have a seven-year warranty I paid for.
